NOTICE-ESPECIALLY THOSE WHO DID NOT MAKE CLASS 12-11.  FINAL EXAM IS ONLINE. The following questions have come up in other classes and are for informational purposes

1.  With respect to whether a minor can own real estate in his/her
own name in Illinois answer is yes.  However, lots and lots of conditions
and only Illinois case is a 1985 fifth district, Deatherage vs Lewis
131 Ill App 3d 685 dealing with adverse possession.  Statute is
760 ILCS 20/10.

2.  With respect to child support and contempt and whether you can be
tossed in jail for civil contempt, it might not be a bad idea to look at
the definitions of various types of contempt.  See, In Re Marriage of
Morse 240 Ill App 3d 296 (1993) Distinction between Criminal and Civil
is nature of sanction.  Criminal = go to jail for set period as punishment
Civil = go to jail to coerce a behavior as I said in class.  By complying
with court's order the jailed person can purge themselves at any time
and get out.

3.  As to substantial change in circumstances, the 2 years is only for
custody.  Everything else is up for grabs, but don't try to go in before
6 months.  And as I said in class, the 2 years for custody also has
 exceptions which are set out in the statute, but again don't try to go
in before 6 months unless you have a really good reason,
(child abuse, etc.)

As an assignment for this class you will be required to go to a domestic relations courtroom or courtrooms.  In the past the question has arisen "Can I just use my own divorce as since I went through it?"  The answer is no.  The reasoning is that you will have a far different prospective although your own experience for comparison purposes will assist you.   Basically, spend at least two hours in one or more courtrooms dealing with family matters.  This can include adoptions or the criminal call for orders of protection, as well as dissolution matters.  I would like you to see a courtroom in action as well as be a "fly on the wall" outside of the courtroom.  [Any county or any Cook County subcircuit]  Eavesdrop on conversations in the hallway.  You usually do not have to worry about listening in since many of the conversations are so loud they can be heard in the parking lot.  Prepare a one to two page summary indicating, when you went, where you went, what you saw, what you heard, what you found interesting and/or new, and what you found that was not to your liking (other than this assignment.)  If you are absolutely unable to go due to work (even over a lunch hour) there will be another project.  We will eliminate one class period to make up for your court attendance. 

Court visit alternative:  for those of you who absolutely could not and cannot visit a divorce court (Family Law) I am looking into an alternative. , it is not an alternative if you can go to court, and you must have my prior approval.

EXTRA CREDIT-BUT STRONGLY ADVISED

TOUR OF CLERK OF THE CIRCUIT COURT OF COOK COUNTY.  ON SEPTEMBER 25, 2008 AND AGAIN ON DECEMBER 11, 2008, THERE WILL BE A TOUR OF THE CLERK'S OFFICE.  THE TOUR STARTS AT 9:00 A.M. WITH ALL INTERESTED PERSONS MEETING ON THE 10TH FLOOR OF THE DALEY CENTER AT RANDOLPH AND CLARK STREETS, CHICAGO.  DO NOT BE LATE AT THERE IS A SHORT INTRODUCTION BEFORE HAND AND THEN THE TOUR IS BROKEN UP INTO SMALLER GROUPS WHICH GO TO DIFFERENT STARTING OFFICES AROUND THE COURTHOUSE. THE TOURS ARE OPEN TO THE GENERAL PUBLIC AND THERE IS A SIGN IN SHEET.  PUT YOUR NAME AND HARPER COLLEGE. 

EXTRA CREDIT WILL ALSO BE GIVEN FOR ATTENDING THE SYMPOSIUM AT HARPER ON OCTOBER 11.
